JUSTICE BIRENDRA KUMAR ORAL ORDER 28-09-2021 This matter has been taken up for out of turn hearing on the prayer of the petitioner for the reason that the petitioner is mother of a two years child and the child is not with the petitioner.

Heard the parties.

Let the defect(s), if any, be removed within four weeks.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 307/34, 120(B) of the Indian Penal Code and Sections 25(1-b)a, 26(i), 35 and 27(i)(ii) of the Arms Act.

Submission is that no specific overt act is alleged against the petitioner, who is a female. Petitioner has got no criminal antecedent. Investigation of the case against the petitioner is already complete.

No.51494 of 2021(2) dt.28-09-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Pasraha Police Station Case No. 50 of 2021, subject to the following conditions:- (a) The petitioner shall fully cooperate with the trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
