JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

The prosecution case is that the petitioner being Incharge Principal of Sri Sitaram + 2 High School, Baraon Kala failed to hand over charge to his successor Pramod Kumar Pandey. It is submitted by the learned counsel for the petitioner that the petitioner is ready to hand over charge but the authorities are not taking the same since the petitioner has filed anticipatory bail application.

Considering the present stand of the petitioner, let the above named petitioner be released on provisional anticipatory bail for four months in the event of arrest or surrender before the

No.31612 of 2015 (2) dt.05-08-2015 2/2 learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas at Sasaram in connection with Akorhi Gola P.S. Case No. 51 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.

In the meantime, the petitioner will hand over charge to the authority concerned. It is expected from the authority concerned to accept charge and issue proper acknowledgment of the same.

The provisional bail of the petitioner will be confirmed by the learned court below if the petitioner hands over complete charge. The provisional bail will also be confirmed by the learned court below if the authority concerned refuses to accept charge.
