Petitioner is in custody in connection with Excise Case No. 264 of 2019 for the offence under section 30(a) and 56(b) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case 30 liters of Mahua wine was recovered from the motorcycle.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 09.05.2019 and nothing was recovered from the possession of the petitioner.

No.39587 of 2019(2) dt.27-06-2019 2/2 Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Gaya, in connection with Excise P.S. Case No. 264 of 2019.
