The petitioner seeks regular bail in connection with Town S. Tr. No.174 of 2017 arising out of Town S.Tr. No.174 of 2017 arising out of Town P.S.Case no.25 of 2017, registered for offences punishable under Sections 324, 326, 307, 498A and 302 of the Indian Penal Code.
Allegation against the petitioner is of causing death of his wife by setting her on fire.
Submission of the learned counsel for the petitioner is that there is no eye witness of the occurrence and nothing has been found to show that she has been set on fire by the petitioner. Heard learned A.P.P. also, who has opposed the prayer for bail stating that the F.I.R. has been lodged on the
Patna High Court Cr.Misc. No.35288 of 2017 (3) dt.09-08-2017 statement of the girl herself, in which she has narrated the whole story of causing setting on her fire.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, as he is in custody, his trial be expedited.
With the aforesaid observation, this application is dismissed.
