====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 16-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Amarpur P.S. Case No. 608 of 2017 registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Sections 25 (1-b)a, 26 of Arms Act. Informant is a Police Officer, who in his written complaint has stated that one Dharmendra Kumar Singh was arrested on the basis of secret information received by him and one motorcycle and one country made pistol was recovered from his possession, on his confession police arrested the petitioner with one motorcycle but he could not produce any valid document of ownership of said motorcycle. However, except the said motorcycle nothing was recovered from the

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case and except one case as stated in Para-3 in Shahkund (Sajour) P.S. Case No. 76 of 2015 under sections 448, 341, 323, 307 and 504/34 of I.P.C., no other criminal case has been instituted against the petitioner. Petitioner is in custody since 18.12.2017. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 608 of 2017.
