The petitioner, who is in custody, seeks bail in connection with Jaipur P.S. Case No. 09 of 2018 registered for the offence punishable under Sections 376/511 of the Indian Penal Code.

Allegation against the petitioner is of attempt to rape.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. It has been further submitted that occurrence took place on 19.03.2018 and FIR was lodged on 26.03.2018 after seven days, which creates serious doubt about the correctness

Patna High Court Cr.Misc. No.37673 of 2018(3) dt.07-09-2018 2/2 of the occurrence. Petitioner has no criminal antecedent and he is in custody since 10.04.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Banka, in connection with Jaipur P.S. Case No. 09 of 2018. (S. Kumar, J) veena/- U T
