The petitioner seeks bail in Khushroopur P.S. Case No. 131/2019, arising out of Special Case No. 4305/2019, instituted for offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner has submitted that recovery of illicit liquor has been made from a bag kept on the road side. Petitioner was standing at the place of occurrence. He has been made accused in this case merely on suspicion. As per seizure-list recovery of illicit liquor has been made from the Pakka road.

It is alleged in the written report that 107 litres of spicy country made liquor has been recovered from possession

Petitioner is in custody since 03.05.2019 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Khushroopur P.S. Case No. 131/2019, arising out of Special Case No. 4305/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.
