The petitioner seeks bail in Goh P.S. Case No. 1 of 2013, instituted for the offence under Section(s) 147, 148, 149, 323, 387 of the Indian Penal Code and Section 17 of C.L.A. Act.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Kail Prajapati who has been granted bail by coordinate Bench of this Court vide order dated 5.1.2016 passed in Cr. Misc. 45435 of 2015. He further submits

Patna High Court CR. MISC. No.41150 of 2019(3) dt.30-07-2019 2/2 that other co-accused also have been granted bail by this Court as well as coordinate Bench of this Court vide orders dated 6.3.2019 and 25.6.2018 passed in Cr. Misc. 13534 of 2019 and 33686 of 2018 respectively.

Petitioner is in custody since 1.5.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Daudnagar, in the District of Aurangabad, in connection with Goh P.S. Case No. 1 of 2013, subject to the condition that both the bailors will be the close relatives of the petitioner.
