JUSTICE SANJAY PRIYA ORAL ORDER 2/ 25-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Begusarai Muffasil P.S. Case No.492 of 2016 instituted for the offence under Section(s) 399, 402, 414 Indian Penal Code, Section 25 (1-b) A, 26, 35 of the Arms Act and Section 30(a), 37(b) of the Bihar Prohibition & Excise Act, 2016.

As per the written report, two live cartridges of .303 bore and one bottle of foreign liquor of 375 ml. have been recovered from the possession of this petitioner. The petitioner is said to be in custody since 05.12.2016.

It has been submitted that some of the co-accused have already been granted bail by the lower court itself.

Patna High Court Cr.Misc. No.24316 of 2017 (2) dt.25-05-2017 2/2 Keeping in view the period of custody, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Begusarai Muffasil P.S. Case No.492 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
