JUSTICE BIRENDRA KUMAR ORAL ORDER 29-08-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 307/341 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation is that the petitioner fired at the informant causing injury at the back of the informant for the reason that the informant was surpassing the petitioner and others in the run competition.

Submission is that allegation of causing fire-arm injury at the left upper arm of the informant is against Ravi Ranjan

Patna High Court Cr.Misc. No.37473 of 2018 (3) dt.29-08-2018 P2/ Pandey, who has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.18944 of 2018. The doctor has found simple injury at the back of the informant. Petitioner is in custody since 01.05.2018. The petitioner has stated on oath that he has got no criminal antecedent.

Considering the nature of allegation and the nature of material, let the petitioner, above named, be released on bail after completion of six months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sasaram (Muffasil) P.S. Case No.35 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
