Patna High Court CR. MISC. No.42012 of 2022(3) dt.13-02-2023 2/3 case registered for the offences punishable under Sections 399/402 of the Indian Penal Code and Sections 25(1-B) a, 26, 35 of the Arms Act.

The prosecution case as per F.I.R is that the police received information that some miscreants have assembled to commit some offence. On getting such information, the police raided the place and arrested four persons. There is recovery of one country made pistol and five live cartridges from each of the petitioner. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. Nothing has been seized from the possession of the petitioners. The petitioners are languishing in custody since 10.03.2022. Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial
