JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. The petitioner being the agnate of the husband of the victim is apprehending arrest in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant after eight year of the marriage by cutting the neck of the informant when suspicion was raised against the entire in-laws family including the petitioner.

It is submitted by learned counsel for the petitioner that considering the materials collected during investigation particularly in paragraph nos. 22, 23 and 24 of the case diary that the injury on the neck of the victim was caused by the father-inlaw with the help of another co-accused Mahadev Nayak

Patna High Court Cr.Misc. No.32178 of 2015 (2) dt.10-08-2015 2/2 and Amlesh Nayak have been granted anticipatory bail vide Cr. Misc. No. 41981 of 2014.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Supaul in connection with Marauna P.S. Case No. 122 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
