The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Gagan Deo Yadav, Advocate. For the Opposite Party/s : Mr. Nand Kishore Prasad, A.P.P. ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 30-06-2015 Heard both sides.

The petitioner apprehends his arrest in a case under Sections 436/34 of the Indian Penal Code.

The petitioner was found fleeing away from the place of occurrence. It is submitted that the informant himself arrived at the place of occurrence on being informed and, therefore, the allegation that the petitioner was seen fleeing away from the place of occurrence does not appear to be worthy for consideration. There is specific allegation that the petitioner threatened the informant of dire consequences and the petitioner and another were seen fleeing away from the place of occurrence while the house of the informant was burning. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail in Khajouli P.S. Case
