The petitioners apprehend their arrest in Ramgarhwa P.S. Case No. 96/2016, registered for the offences punishable under Section 384 and other sections of the Indian Penal Code. The informant alleged that while he was constructing his house, the petitioners came and demanded extortion. The petitioners are alleged to have damaged the construction materials and Rita Devi is alleged to have snatched Rs. 5,000/- and chain made of gold from the informant.
Learned counsel for the petitioners submits that in fact the land was standing in the name of Raghuni Mahra
Patna High Court Cr.Misc. No.26380 of 2017 (2) dt.13-07-2017 2/2 grandfather of petitioner no. 2, but the informant purchased the land from someone else and wanted to dis-possess the petitioners from the aforesaid land. On account of land dispute, this false case has been lodged.
Considering the facts aforesaid, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Raxaul at Motihari in connection with Ramgarhwa P.S. Case No. 96/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
