====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 17-09-2018 Heard learned counsel for petitioner and learned counsel for the State as well as counsel for Informant. Petitioner, who is in custody, seeks bail in connection with Danapur P.S. Case No. 547 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 302 and 120 (B) of the Indian Penal Code and 27 Arms Act.

Petitioner is not named in F.I.R. Infromant is the eye witness of occurrence. He has named 22 persons as accused and 5 unknown persons as accused and specific allegation is against accused Prem Ratan Rai and Arjun Rai of firing from their pistol on deceased causing his death.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.38053 of 2018(4) dt.17-09-2018 2/2 that he is innocent and has committed no offence. He has been falsely implicated in this case only on the confessional statement of other co-accused person. It has been further submitted that similarly placed co-accused have been granted anticipatory bail and bail by co-ordinate Bench of this Court as contained in Annexure 2 and 3 series.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Danapur in connection with Danapur P.S. Case No. 547 of 2017.
