JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 379/411 of the Indian Penal Code.

According to F.I.R. unknown person committed theft of motorcycle of the informant.

Submission is that the stolen motorcycle was not recovered from the possession of the petitioner and he is in custody since 25.10.2016. Petitioner has falsely been implicated on suspicion and he has got criminal antecedent. Charge sheet has already been submitted. Petitioner is ready to cooperate in the trial.

No.28203 of 2017 (2) dt.03-07-2017 2/2 Considering the period already undergone, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court, in connection with Araria P.S. Case No.610 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
