The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, four accused persons on two motorcycles on being stopped for checking managed to escape leaving behind their motorcycles. 72 litres of liquor was recovered. The petitioner was identified amongst the four persons by the villagers.

It is submitted by learned counsel for the petitioner that he has been falsely implicated in the case and was not caught at the place of occurrence. He has no concern with the seized liquor nor with the motorcycles in question. He is in custody since 8.7.2021.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not having been arrested at the spot, chargesheet having been submitted and the petitioner having remained in custody for 7 months, the Court directs the petitioner to be enlarged on bail in connection with Gopalpur P.S. Case no.54 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge, Gopalganj.
