The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409 and 420/34 of the Indian Penal Code.
It is a case of embezzlement of government money by the accused persons.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that similarly situated co-accused persons have already been granted anticipatory bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 83782 of 2019 and Cr. Misc. No. 11730 of 2020 and also similarly situated co-accused has already been granted anticipatory bail by a Co-ordinate
Patna High Court CR. MISC. No.2329 of 2021(4) dt.11-05-2022 2/2 Bench of this Court passed in Cr. Misc. No. 82622 of 2019. Petitioner has got clean antecedent.
Learned APP appearing for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM(ii), Aurangabad in connection with Dhibra P.S. Case No. 06 of 2019/G.R.No. 1003 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
