Petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code and thereafter converted into 395 of the Indian Penal Code.

The FIR of the occurrence of robbery is against unknown. The petitioner is in custody since 01.05.2018.

Submission is that the petitioner was never put on T.I. Parade nor anything was recovered from his possession. Only confessional statement of co-accused before the police is material against the petitioner which is not an evidence according to law.

Patna High Court Cr.Misc. No.36120 of 2018 (4) dt.25-08-2018 2/2 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sonepur Police Station Case No.121 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
