JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner and learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

The alleged occurrence appears to have taken place on account of throwing garbage and, initially, three persons started assaulting the daughter-in-law of the informant but, subsequently, when the informant's son went to rescue his wife, petitioner and other co-accused also joined the aforesaid three persons and started assaulting the informant, informant's son as well as his daughter-in-law. All the three injured appears to have sustained injuries. The informant, informant's son and daughter-in-law sustained grievous injuries as well as simple injuries. No doubt, petitioner is named in the first information

Patna High Court Cr.Misc. No.42541 of 2016 (2) dt.06-10-2016 2/2 report but no specific overt act has been attributed against him. Petitioner is in jail custody since 25.05.2016 and there is also counter version of the case.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in connection with Ghosi P.S.Case No. 149 of 2016.
