JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307 and 379 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioners appears to be right in his submission that there is no specific allegation of any overt act against these petitioners except petitioner no. 4, namely, Abu Torab and
Patna High Court Cr.Misc. No.46887 of 2014 (3) dt.07-05-2015 2/2 petitioner no. 10, namely, Saidu Rahman @ Saidur Rahman. He has further submitted that though there is allegation against the petitioner no. 4 that he hit the informant with his Bhujari, but no grievous injury has been found on the person of the informant.
In view of the nature of allegation as well as the submission that there is long standing dispute between both the sides, let the petitioners, abovenamed, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Hathua P.S. Case No. 28 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
