The petitioner has been in custody since 05.04.2019 in connection with Sherghati (Dobhi) P.S. Case No. 146/2019 registered for the offence punishable under Sections 414/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the allegation under Section 414 is only misconceived at that point of time, the vehicle was not having its paper and, therefore, could not have been produced. It is however, submitted that the necessary papers would be produced as and when required. The further allegation against the petitioner is about recovery of 20 bags of Mahua flowers is explained in the manner that the petitioner is merely a driver of the vehicle and has nothing to do with anything which is being carried thereon and cannot question its presence on the vehicle which belongs to the owner.

Case No. 146/2019.
