ANJANA MISHRA ORAL ORDER 04-08-2015 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Petitioners are apprehending their arrest in connection with Minapur P.S.Case No. 336 of 2011 registered for the offences punishable under Sections 147, 436 and 427 of the I.P.C. Learned counsel for the petitioners submits that the petitioners have been named in the F.I.R. by the informant after receiving information about the occurrence by the villagers. It is further submitted that two other co-accused persons namely, Ratan Sah and Vijay Sah have been directed to surrender before the Court of learned Chief Judicial Magistrate, Muzaffarpur.

After perusal of the F.I.R. and the nature of the

No.30124 of 2015 (2) dt.04-08-2015 2/2 allegations and also the fact that the informant in his statement has given contradictory version, that first, he has seen the occurrence and thereafter, he stated that he came to the place of occurrence only after receiving information and then the petitioners have been named on mere suspicion, let the above named petitioners, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S.CaseNo. 336 of 2011, subject to condition as laid down under Section 438(2) of Cr. P.C.
