JUSTICE PURNENDU SINGH ORAL ORDER 14-02-2023 Heard Mr. Akhilesh Kumar Sinha, learned counsel appearing on behalf of the petitioner and Mr. Anisul Haque, learned AC to learned AAG-5 for the respondents.

2. Forced by the action of the respondent no.3- the Commissioner, Magadh Division, Gaya, who is sitting tight over the matter petitioner has sought mandamus to direct the respondent no.3 to dispose of the Revision Case No. 406 of 2018 in accordance with law.

3. Considering the limited relief sought for in the present writ petition, respondent no.3- the Commissioner,

Patna High Court CWJC No.10777 of 2022(2) dt.14-02-2023 2/2 Magadh Division, Gaya, is directed to call for the records of the Revision Case No. 406 of 2018, which is pending in his office for adjudication. Forthwith fix a date of hearing and intimate the date to the petitioner without further delay to provide him opportunity of hearing to place his case.

4. Respondent no.3- The Commissioner, Magadh Division, Gaya is further directed to pass an order in accordance with law within a period of 30 days from the date of issuance of notice to the petitioner fixing the date of hearing.
