In the background of the prevailing dispute amongst the parties, it has been alleged that on the alleged date and time of occurrence, petitioner along with his sons, Lav Kumar and Kush Kumar abused. On protest made by the informant, petitioner is said to have inflicted Farsa blow over back of neck followed with assault by lathi by his sons.

The order impugned simply refers presence of injury report under Para-16 of the case diary. Annexure-2 is the injury report which speaks presence of lacerated wound on middle of head 3" x 1⁄2" x skin deep, pain all over body. Petitioner happens to be under custody since 09.09.2016, having no criminal antecedent

Accordingly, petitioner, Bhikhari Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Chautham P.
