The petitioner seeks bail in Kotwa P.S. Case No. 78 of 2016 registered under Section 392 of the Indian Penal Code. As per the prosecution case, accused persons are said to have looted the pick up van of the informant on the highway in the night.
It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no offence. He has been falsely implicated in this case. Nothing incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner is not named in the F.I.R and he was not put on T.I.P. Co-accused Sanjay Ram
Patna High Court Cr.Misc. No.29366 of 2017 (2) dt.01-07-2017 2/2 has been enlarged on bail by this Court vide order dated 04.05.2017 passed in Cr. Misc. No. 17633 of 2017. The petitioner has been languishing in custody since 04.10.2016. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, East Champaran, Motihari in connection with Kotwa P.S. Case No. 78 of 2016.
