2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 137(2), 103(1), 238, 61(2) and 3(5) of the B.N.S.

3. The case of the prosecution, in short, is that on 02.05.2025, the informant's husband left home to attend natural call but he did not return and subsequently, his dead body was recovered from a sugarcane field.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the petitioner has submitted that in this case, the occurrence is of 02.05.2025 whereas the F.I.R. has been lodged on 03.05.2025. It has further been submitted that

During course of investigation, one co-accused Sandesh Kumar Singh was apprehended and he has given his confessional statement in which name of this petitioner has surfaced. It has further been submitted that co-accused Sandesh Kumar has already been granted bail by learned Co-ordinate Bench of this Court vide Cr. Misc. No. 73119 of 2025. The case of this petitioner stands on similar footing. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 24.03.2026.

5. Learned APP appearing for the State has vehemently opposed the application for bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Vishambharpur P.S. Case No. 96 of 2025.
