Having regard to the admitted position that the petitioner is not only facing prosecution for offence under Section 406 and 409 of the Indian Penal Code but also has given a false statement before this Court in paragraph no.3 of the bail petition claiming to have clean antecedent, whereas, learned counsel for the informant has produced copy of the First Information Report of Basnahi P.S. Case No. 9 of 1992, wherein, the petitioner is an accused and charge-sheet also has been filed in the aforesaid case by the police, this Court would not find the petitioner entitled for privilege of anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner, namely, Maheshwari Ram is rejected.
