The Petitioner seeks bail in Bihiya P.S. Case No.140 of 2016 instituted for the offence under Section(s) 363, 366-A, 120-B/34 Indian Penal Code.

It has been submitted that there is specific allegation of overt act against co-accused, Munna Paswan. The victim girl has been recovered from the possession of Munna Paswan. The victim girl in her statement under Section 164 Cr. P. C. has levelled specific allegation against Munna Paswan. The petitioner is in custody since 18.10.2016.

From the written report, it appears that the Informant has alleged that all the accused persons have kidnapped his sister.

In such circumstances, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Arrah, in connection with Bihiya P.S. Case No.140 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
