JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 This is an application seeking anticipatory bail in a case registered for the offences punishable under sections 341, 323, 302/ 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that the allegation of assault in the first information report is general and omnibus and there is no specific allegation against this petitioner. He has further submitted that it will cause great prejudice to the petitioner if he is taken into custody as he is a member of Bihar Military Police.
In view of the gravity of the offence, I am not inclined to entertain this application for anticipatory bail. This application is, accordingly, rejected.

No.50396 of 2014 (2) dt.07-05-2015 2/2 The petitioner is directed to surrender before learned Chief Judicial Magistrate, Motihari in Govindganj PS case No. 83 of 2014 within a period of four weeks from today and seek regular bail, if so advised. If he does so, the court below shall consider his prayer for regular bail on its own merit without being prejudiced by rejection of present anticipatory bail application.
