JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being Professor and Head of the Department of Political Science of J.P. University is apprehending arrest in a case registered for the offences punishable under Sections 409,420,467,468,471,477A/34 and 120B of the Indian Penal Code and sections 13(2) read with 13(1)(d) of P.C. Act. The prosecution case is that the Vice Chancellor along with others including the petitioner being the Member of the Purchase Committee, under a criminal conspiracy, without inviting any tender, approved the quotation of M/s Chandra Prabha Universal Pvt. Ltd. for purchase of answer books on higher rate with a view to provide wrongful benefit to the aforesaid firm and thereby conspired to misappropriate the government money

Patna High Court Cr.Misc. No.31273 of 2015 (2) dt.31-07-2015 2/3 by forging records in violation of Government rules and financial regulation and caused loss to the government exchequer to the tune of Rs.1,44,00,000/-. The firm in question was chosen for the first time for purchase of the answer sheets. It is submitted by the learned counsel for the petitioner that the petitioner was Member of the Purchase Committee but the specific accusation has been levelled against the Vice Chancellor who took final decision for purchase of answer sheets, has been granted anticipatory bail vide Cr. Misc. No. 24474 of 2015 and similarly situated accused Anita being Member of Purchase Committee has also been granted anticipatory bail vide Cr. Misc. No. 26015 of 2015.

It is submitted by learned counsel for the Vigilance that the petitioner being Member of the purchase committee, is a part of the whole scheme of misappropriation of public money. Considering the fact that the main accused Vice Chancellor of the University and the similarly situated accused Anita have been granted anticipatory bail, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance (North Bihar), Muzaffarpur, in
