The petitioner seeks bail in Sadar P.S. Case No. 193 of 2018 (Special Case No. 53 of 2018) registered for the offence punishable under Sections 341, 342, 372, 373, 376, 366(A), 120B of the Indian Penal Code, Section 3, 4, 5, 6 & 7 of Immoral Trafficking Act, Section 23 J.J. Act and Section 3/4 of the POCSO Act.

Informant is Dy.S.P. who in his written report has stated that he received secret information on 05.05.2018 that

Patna High Court Cr.Misc. No.35950 of 2018(3) dt.18-08-2018 2/3 some minor girls were being sexually exploited and on the basis of said information raid was conducted near Khuskibagh, Katihar, at about 4:30 pm and during raid one Akbar Khalifa was apprehended along with 14 ladies and 5 male persons. It has been submitted on behalf of the petitioner that she is innocent and has been falsely implicated in this case. It has been further submitted that the name of the petitioner has surfaced in this case on the basis of statement of co-accused namely, Reshma Khatoon, Rabhina Begum and Shabnam Khatoon, who have already been granted bail. Similarly situated co-accused persons have been granted bail by a co-ordinate benches of this Court vide orders dated 05.07.2018 in Criminal Miscellaneous No. 39040 of 2018, dated 12.07.

2018 in Criminal Miscellaneous No. 39904 of 2018, dated 19.07.2018 in Criminal Miscellaneous No. 42226 of 2018, dated 26.07.2018 in Criminal Miscellaneous No. 43386 of 2018. Petitioner has got no criminal antecedent and is in custody since 06.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs.
