1. Heard learned counsel for the petitioner, learned APP for the State and the learned counsel appearing on behalf of the informant.
2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 74, 303(2), 352, 351(2), 351(3), 3(5) of the B.N.S.

The learned counsel for the petitioner submits that the petitioner has antecedent of four cases, but then all the cases have been instituted by the informant and her side as has been pleaded at Para-3 of the anticipatory bail application. It is next submitted that informant alleges that on 15.02.2026 at 1.00 P.M. she was getting some work done on her land when four named

On protest, nine named accused persons came and started abusing and the accused dashed her on the ground and petitioner assaulted her by dabiya causing injury on head while Arshad assaulted Dilshad by sabal causing injury on head and accused also assaulted Dilabar and Rizwan tore her clothes.
4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant on account of dispute relating to land. It is next submitted that petitioner is step-brother of the husband of the informant, but then the said relationship is concealed in the FIR and an impression is being created as if accused persons came on the land and thereafter the occurrence took place. It is also submitted that on account of dispute relating to property, the side of the informant is implicating the petitioner and his side in different cases. It is next submitted that even presuming what has been alleged is true without admitting, then the injury suffered by the injured has been opined to be simple in nature caused by hard and blunt substance as would manifest from the injury report annexed as Annexure-2 series.
5. Learned A.P.P. as well as the learned counsel
Patna High Court CR. MISC. No.40563 of 2026(2) dt.02-07-2026 3/3 appearing on behalf of the informant opposes the anticipatory bail application, but then, the learned counsel appearing on behalf of the informant is not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioner that petitioner is step-brother of the husband of the informant and said fact stands concealed in the FIR.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Palasi P. S. Case No.70 of 2026, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
7. The application stands allowed.
