ANJANA MISHRA ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner being the husband of the complainant apprehends his arrest in connection with Complaint Case No. 528/2014 registered for the offences punishable under Sections 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the motherin- law of the petitioner is instrumental in lodging of the present case and interfering in their happy married life. He further submits that the petitioner is willing and ready to keep his wife with full honour and dignity and ensures that she and her two children will live in their house in all peace in Delhi. He further submits that there shall be no recurrence of any untoward act so as to prejudice

Considering the bonafide offer made by the petitioner, let the petitioner Munirak, in the event of his arrest / surrender within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Nawada in connection with Complaint Case No. 528/14 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
It is, however, made clear that if there is any recurrence of any unusual event relating to lady in question or any prejudice being caused to her or her two children, it would be open to her to move this Court for appropriate action.
