This is an application for bail in connection with Islampur P.S.Case No. 83 of 2017 registered for the offences punishable under Section 394 of the Indian Penal Code. Allegation against the petitioner is of committing robbery on the highway and he has been arrested at the spot and there is recovery of looted cash from him.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to village rivalry and earlier he has no criminal antecedent but later on he has been made accused in this case and he is in custody since 2.4.2017. Heard learned APP also.
Having heard both sides and considering the aforesaid
Patna High Court Cr.Misc. No.28756 of 2017 (3) dt.02-08-2017 2/2 facts and circumstances, I am not inclined to grant bail to the petitioner at this stage.
However, learned trial court is directed to expedite the trial and try to conclude it within seven months. If trial is not concluded within the said period, petitioner may renew his prayer for bail.
With the above observation, this application is dismissed.
