The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 380, 364 and 448 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the accused persons including the petitioners variously armed entered into the house of the informant when co-accused Vinay Kumar Singh assaulted on the head of the informant with 'farsa', co-accused Romi Kumari assaulted on the arm and back of the informant with stick whereas unknown persons assaulted on leg of the informant when wife of the informant came to rescue she was also assaulted. It
Patna High Court Cr.Misc. No.30254 of 2015 (2) dt.30-07-2015 2/2 is further alleged that the petitioners tried to take the informant on motorcycle.
It is submitted by learned counsel for the petitioners that specific accusation of assault is not against these petitioners.
Considering the nature of accusation, this Court is not inclined to grant anticipatory bail to the petitioners. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Kotwa P.S. Case No.3 of 2013, pending before the learned Judicial Magistrate, 1st Class, Motihari, East Champaran.
With the above observation, this application is, accordingly, disposed off.
