JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the police upon investigation submitted final report in this case holding the petitioner's implication to be a mistake of fact. The Court below, however, took cognizance of the offence differing with the report of the investigating officer. Learned counsel for the petitioner has submitted that since the investigation is complete, no custodial interrogation is required.

Patna High Court Cr.Misc. No.51408 of 2014 (2) dt.07-05-2015 In view of the submission as above, let petitioner above named in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhbani in Pandaul P.S.
