JUSTICE SANJAY PRIYA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 25(1-B)A, 26 and 35 of the Arms Act. It is alleged that one country made pistol with live cartridge was recovered from the possession of the petitioner. Besides this, five silver coins, one locket, one earring, two gold rings and one mobile were also recovered. The seizure list has been prepared and enclosed with the written report. It has been submitted that the petitioner has no criminal antecedent. Another case arising out of the same occurrence has been filed wherein the petitioner has been named as one of the accused. The petitioner is in custody since 30.8.2016.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.899 of 2017 (2) dt.12-01-2017 2/2 the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Lakhisarai, in connection with Halsi P.S. Case No. 111 of 2016 subject to the condition that both the bailors will be the close relatives of the petitioner.

The petitioner is directed to remain physically present on each and every date in the lower court during the trial and default on two subsequent dates by the petitioner will result in cancellation of bail bond of the petitioner in the lower court. It is made clear that the petitioner will not attempt to delay the disposal of the trial after grant of bail by this Court. (Sanjay Priya, J) S.Ali/- U T
