Impersonating mother of informant, Mustaque Alam through his wife Mariyam Nisha succeeded in withdrawing the amount allotted to his mother in lieu of Indira Awas Yojna. Petitioner is the BDO having no concern with the affair of the bank and that being so, petitioner Shahid Jamal is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Kadwa (Balai Belon) P.S. Case No.94 of 2013 in the event of his arrest / surrender within four weeks in terms of condition so laid down under Section 438(2) Cr.P.C. (Aditya Kumar Trivedi, J.) PN/- U T
