1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B) and 201/34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the instant regular bail application has been filed in terms of the liberty granted to the petitioner by order dated 10.05.2023 in Cr. Misc. No. 31424 of 2023 whereby the petitioner was given liberty to file bail application after the charges are framed. It is further submitted that the charges against the petitioner was framed by order dated 03.02.2024. It is next submitted that petitioner is in custody since 14.08.2020. It is also submitted that petitioner will not abscond rather will cooperate in the trial.

4. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.

5. Considering the aforesaid submissions, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Session Trial No. 174 of 2022 arising out of Danapur P.S. Case No. 444 of 2020.

6. However, if the learned trial court comes to a conclusion that petitioner, after his release on bail, is trying to delay the trial of the case in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner after recording reasons.
