2. The petitioner seeks regular bail in connection with Khizersarai P.S. Case No. 13 of 2022 dated 10.01.2022, lodged under Sections 304(B) and 34 of the I.P.C.

3. As per the prosecution case, the F.I.R. has been lodged against six named accused persons including the petitioner. The allegation of Sections 304(B) and 498(A) of the I.P.C. is there in the F.I.R. against all the accused persons.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner is the Nanad of the deceased aged about 46 years, she is married and having separate establishment. He further submits that antecedent of the petitioner is clean and she is in custody since 15.09.2022.

5. Learned A.P.P. for the State opposes the prayer for bail and submits that the petitioner is Nanad of the deceased and in custody since 2022 but it is also true that husband has still not surrendered.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Ist, Gaya in connection with S.Tr. No. 177 of 2023 and 826 of 2022 arising out of Khizersarai P.S. Case No. 13 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

7. With this observation, the bail application stands allowed.
