2. The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Deepnagar P.S. Case no. 163 of 2024 instituted for the offence under Sections 147, 148, 149, 341, 342, 323, 324, 307, 337, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution is that on 18.05.2024, there was electric failure in the village of the informant and an electrician was working to restore the defect. In the meanwhile, some persons from a paraticular caste came there and told the electrician to restore electric supply immediately, over which, there was an altercation with the electrician. No.40362 of 2025(2) dt.04-07-2025 2/3 members of the informant objected, the accused persons name in the FIR including the petitioner along with 15-20 unknown persons variously armed with 'lathi', 'danda' and 'bricks etc. started pelting stones and resorted to indiscriminate firing, due to which, four persons sustained firearm injuries.
4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that the petitioner was not present at the place of occurrence and to substantiate this fact, he brought to the notice of this Court Annexure -2, letter written to Superintendent of Police, Biharsharif, Nalanda regarding C.C. Tv. Footage of his shop. It is further submitted that the nature of allegation is general and omnibus. Further submission is that co-accused person has since been extended the privilege of bail vide order dated 26.10.2024 passed in Cr. Misc. No. 71884 of 2024. The case of this petitioner stands on similar footing.
5. Learned APP appearing for the State vegemently opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner

No.40362 of 2025(2) dt.04-07-2025 3/3 is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Deepnagar P.S. Case no. 163 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
