2. The petitioner seeks bail in Nawada Nagar (NWD) P.S. Case No. 1127 of 2024 (S.Tr. No. 51 of 2025) instituted for the offences under Sections 103(1) and 3(5) of BNS pending in the Court of ADJ-II, Nawada. He has no criminal antecedent.

3. As per the prosecution case, the informant has alleged that he received a call from his nephew (Bhagina) that his sister has suffered injuries on her head, eyes and legs and has stated that she was brutally assaulted by her in-laws including the petitioner and subsequently killed.

4. Learned counsel for the petitioner submits that there is general and vague allegations levelled against the petitioner and nobody is an eye-witness to the occurrence. It is fur-

No.38527 of 2025(3) dt.06-08-2025 2/3 ther submitted that similarly situated co-accused persons namely Vijay Manjhi and Lalsi Devi have been granted bail by a Co-ordinate Bench of this Court. It is also submitted that charges have already been framed and only one prosecution witness has been examined till date and there is no likely-hood of conclusion of the trial in near future. It is lastly submitted that the petitioner has no criminal antecedent and he is in custody since 16.10.2024.

Learned Additional Public Prosecutor for the State has vehemently opposed the prayer for bail of the petitioner and has submitted that from perusal of the post-mortem report it would suffice that the deceased had sustained six ante mortem injuries and cause of death is found to be head injury caused due to physical assault as such the petitioner should not be released on bail.

6. Considering the aforesaid submissions of learned counsel and taking into account the nature of allegations in the post-mortem report, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.

7. The Trial Court is directed to expedite the trial of the case.

8. It is made clear that the observations, if any, made
