The petitioners seek regular bail in connection with Katihar Rail P.S. Case No. 20 of 2017, registered for the offences punishable under sections 8, 20 and 22 of the NDPS Act. Allegation against the petitioners is of recovery of 50 kgs. of Ganja from their conscious possession. Submission of learned counsel for the petitioners is that there is noting available on record to show that the same has been recovered from conscious possession of the petitioners and they have been arrested only on the basis of suspicion. Recovery has been made from behind the truck and there is no criminal
Patna High Court Cr.Misc. No.29403 of 2017 (3) dt.18-07-2017 antecedent and further he is in custody for four months. Heard learned APP also.
Having heard both sides and in view of the huge quantity recovered from the possession, I am not inclined to grant bail to the petitioners. As such prayer for bail of the petitioners is rejected. However, the trial may be expedited. This application is accordingly dismissed.
