2. The petitioners apprehends their arrest in connection with Udakishunganj P.S. Case No.50 of 2026, dated 14.02.2026, registered for the offence punishable under Sections 69, 105, 140(1), 3(5), 103(1), 238, 61(2) of the Bharatiya Nyaya Sanhita.
3. As per the FIR, co-accused Rishu Raj allegedly developed physical relationship with the daughter of informant on false promise of marriage, as a result of which she became pregnant. It is alleged that he took her to the Sub- Divisional Hospital, Haraili where she delivered a male child, and thereafter the petitioners are said to have fled away with the
Patna High Court CR. MISC. No.42611 of 2026(2) dt.01-07-2026 2/3 child, leaving the victim in the hospital. The victim subsequently died due to excessive bleeding while being shifted for better treatment.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. It is submitted that the petitioners are the sisters of coaccused Rishu Raj and the only allegation against them is that they fled away with the newly born child along with Asha Devi, the mother of co-accused Rishu Raj. It is next submitted that the informant and his family members had taken the deceased from the said hospital for medical treatment, where the victim died. It is further submitted that co-accused Asha Devi has already been granted anticipatory bail vide order dated 23.06.2026 passed in Cr. Misc. No. 40133 of 2026. Lastly, it is submitted that the petitioners have no criminal antecedents.
5. On the other hand, the learned APP for the State has opposed the prayer for bail of the petitioners.
6. Considering the facts and circumstances of the case and taking into account that similarly situated co-accused has been granted bail, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from
Patna High Court CR. MISC. No.42611 of 2026(2) dt.01-07-2026 3/3 today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura/Successor Court in connection with Udakishunganj P.S. Case No.50 of 2026, subject to the conditions as laid down under Section 482(2) of the BNSS as well as the following conditions:
(i) One of the bailors should be the family member/relative/ known of the petitioner(s) who shall provide official document/ personal affidavit to show his/her bona fide;
(ii) the petitioner(s) shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his/her/their bail bond by the Trial Court itself;
(iii) the petitioner(s) shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(iv) the petitioner(s) shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds.
