JUSTICE SUDHIR SINGH ORAL ORDER 31-07-2015 The petitioner is apprehending his arrest in connection with Sabour (Goradih) Police Station Case No. 313 of 2014 for the offences instituted under Sections 341/323/307/504/506/34 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

Prosecution case, in short, is that on the date of occurrence the informant was going to plough his field, the F.I.R. named accused persons started abusing him and on protest being made the accused Rajendra Yadav gave a Khanti blow on his head due to which blood oozed out and he fell down. When his brothers came to save him then they were also assaulted by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. As per the allegation the petitioner is said to have assaulted the victim but from perusal of the injury report it appears that the injury is simple in nature.

Considering the aforesaid facts and circumstances, it is directed that the petitioner shall be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Sabour (Goradih) P.S. Case No. 313 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
