Petitioner seeks regular bail in connection with Piar (Pear) P.S. Case No.19 of 2017/Spl. Ex. No.49 of 2017 registered for the alleged offences under Sections 30 (a) and 38/41 of the Excise Act, 2016.

As per the prosecution case, several liters of illicit liquor were recovered from the vehicle and two accused persons, namely, Rajiv Kumar and Vivek Kumar were apprehended and other persons managed to escape from the spot. It has been submitted by learned counsel for the petitioner that the petitioner is an innocent and has committed no offence. The petitioner was not apprehended on the spot. Patna High Court Cr.Misc. No.29430 of 2017 (02) dt.01-07-2017 2/2 petitioner. He has been named in the case only on the basis of a disclosure made by one co-accused. He has been falsely implicated in this case. The allegations levelled against the petitioner are general and omnibus in nature. He has been languishing in jail custody since 03.04.2017. One co-accused Saroj Rai has been granted bail by this Court in Cr. Misc. No.26543 of 2017 vide order dated 14.06.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned 3rd Additional Sessions Judge-cum-Special Judge Excise, Muzaffapur in connection with Piar (Pear) P.S. Case No.19 of 2017/Spl. Ex. No.49 of 2017.
