The petitioner seeks bail in connection with Rampur P.S. Case No. 326 of 2016 registered for the offence punishable under Sections 414 of the Indian Penal Code and Section 52 of the Jail Act.
Informant who is Jail Superintendent, Gaya Central Jail, in his written report has stated that during inspection of high security room bearing no. 22A by him, one mobile phone without SIM was recovered from the possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is innocent and has been falsely implicated in this case. It has been further submitted that offence under Section 52
Patna High Court Cr.Misc. No.34579 of 2018(3) dt.14-08-2018 2/2 of the Jail Act is bailable.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya, in connection with Rampur P.S. Case No. 326 of 2016.
