ANJANA MISHRA ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Ara (Muffasil) P.S. Case No.129 of 2015 for allegedly having committed the offence under Section 307 of the Indian Penal Code and Section 3(x)(xi) of the S.C./S.T. Act.

Learned counsel for the petitioner submits that so far the provision of Section 3(x) (xi) of the S.C./S.T. Act is concerned, the same is not made out in the present context as there is no allegation attracting the said provisions. Learned counsel for the petitioner further submits that the child was treated in the hospital by the petitioner and there is no element

Considering the aforementioned submissions and also the fact that the petitioner has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Navin Kumar Srivastava, learned Judicial Magistrate, 1st Class, Bhojpur at Ara, in connection with Ara (Muffasil) P.S. Case No.129 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
