The petitioner has prayed for bail a case registered for the offence punishable under sections 419, 420, 387, 504/34 of the Indian Penal Code and sections 66(c ) and 67 of the I.T. Act. As per allegation in the FIR, petitioner is in the habit of viral the obscene photographs of the informant and his wife on social media ever after the Panchayat.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is innocent. For the alleged occurrence of 10.02.2021, FIR has been lodged after much delay on 5.4.2021 without any plausible delay. Both parties are agnates. No offence u/s 387 IPC is made

Patna High Court CR. MISC. No.40722 of 2022(3) dt.15-02-2023 2/2 out against the petitioner. Petitioner is languishing in judicial custody since 12.01.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 243 of 2021.
